Sedan den 26 augusti har 295 tillverkare fått MDO för mer än 1 089 000 produkter.Sedan deadline för att ta bort otillåtna produkter från marknaden den 9 september har FDA Tobacco Products Center inte godkänt några e-cigarettprodukter för marknadsföring. Produkter som avvisats av PMTA bör tas bort från marknaden eller föremål för ytterligare upprätthållande av FDA.FDA uppgav att dess högsta verkställighetsprioriteringar inkluderar produkter som har fått MDO eller aldrig har skickats in för granskning.Alla för närvarande tillgängliga produkter är dock fortfarande tekniskt föremål för FDA:s efterlevnadsutrymme, inklusive de från massmarknadstillverkare av e-cigarett som Juul Labs och Reynolds Americans varumärke Vuse.

Med den första omgången av MDO tillkännagav FDA en tidigare opublicerad standard som kräver att PMTA används för att smaksätta andra produkter än tobak och mentol för att visa att tillräckliga specifika produktvetenskapliga bevis bevisar tillräckliga fördelar för vuxna rökare.Övervinna riskerna för tobak och mentol.

För första gången sedan FDA tillkännagav kravet har den vägrat att öppna systemtillverkare som har resurser att inkludera sådana bevis i sin PMTA.Tidigare idag var de amerikanska e-vätsketillverkarna Turning Point Brands och AVAIL Vapor ett av företagen som fick MDO denna vecka, främst för applikationer med smaksatta e-cigarettprodukter.

Andra som tros ha lämnat in en stor mängd vetenskapliga bevis i sin PMTA har också fått MDO, inklusive tillverkaren av Bidi Stick engångs-e-cigaretten.Några välkända och väletablerade tillverkare av e-vätskor har fått MDO, inklusive Beard Vape Company, Cosmic Fog, Ruthless och Mister E-Liquid.
